General Terms and Conditions (GTC) of the BigParking Platform
1. Scope of Application
These General Terms and Conditions (GTC) apply to the use of the BigParking online platform under the domain www.bigparking.de and associated subdomains, in particular bookings.bigparking.de.
BigParking offers users the opportunity to compare parking offers near airports and ports and to book parking services with affiliated parking providers.
Deviating conditions of the customer are not recognized unless BigParking expressly agrees to their validity in writing.

3. BigParking's Brokerage Service
BigParking operates an online platform for brokering parking services.
The contract for the provision of the parking service is concluded exclusively between the customer and the respective parking provider.
BigParking does not become a contractual partner for the parking service itself, but handles the brokerage as well as the technical processing of the booking and payment.
The responsibility for the execution, organization, and quality of the parking service lies with the respective parking provider.
4. Conclusion of Contract
The presentation of parking offers on the platform does not constitute a legally binding offer, but an non-binding invitation to book.
By completing the booking process, the customer submits a binding offer to conclude a contract with the parking provider.
The contract is concluded as soon as the customer receives a booking confirmation by email.
5. Prices and Availability
The prices and availabilities displayed on the platform are based on the information provided by the respective car park provider.
Despite careful maintenance, discrepancies may occur in individual cases, especially if price changes or capacity adjustments have not been communicated to BigParking in a timely manner.
A confirmed booking is binding for the car park provider.
The car park provider is obliged to provide the booked service under the conditions stated in the booking confirmation.
Subsequent price demands against the customer are inadmissible, unless the customer has made changes to the booking.
Obvious pricing errors remain unaffected. In this case, BigParking will inform the customer immediately and offer an amicable solution.
6. Payment Processing
Payment is made via BigParking or an external payment service provider (e.g. Stripe), depending on the offer.
BigParking is entitled to receive payments on behalf of the car park provider and then forward them to the provider.
The charge is made at the time of booking, unless otherwise specified.
7. Cancellation and Rebooking
Unless otherwise stated in the booking confirmation, the customer can cancel their booking free of charge up to 24 hours before the booked arrival time.
After this period, free cancellation is excluded. The agreed booking price remains due in full and will not be refunded.
Fees already incurred by payment service providers (e.g. credit card, PayPal or similar transaction fees) will not be refunded regardless of the time of cancellation.
Rebookings are only possible subject to availability and in consultation with the respective car park provider.
8. Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
For services related to leisure activities with a specific date or period, the right of withdrawal may be excluded in accordance with § 312g para. 2 no. 9 BGB.

9. Customer Obligations
The customer is obliged to,
provide correct information when booking
to follow the instructions of the parking provider
to adhere to agreed arrival times
to communicate changes or delays in good time
In the event of significant delays, additional fees may be incurred by the parking provider.
10. Additional services and additional costs
Additional services such as vehicle cleaning, refueling service, charging service, night surcharges or special services may apply depending on the parking provider.
These can be found in the respective provider information and are charged by the provider.
11. Liability for vehicle and damages
The respective parking provider is generally responsible for damage to the vehicle, loss of items or other impairments in connection with the parking service.
The insurance and liability conditions of the respective parking provider apply.
BigParking is not liable for damages arising in connection with the provision of the parking service, unless there is its own intentional or grossly negligent conduct.
12. Platform liability
BigParking is liable without limitation for intent and gross negligence.
In the event of simple negligence, BigParking is only liable for the breach of essential contractual obligations (cardinal obligations) and limited to foreseeable damage.
Liability for indirect damages, consequential damages or lost profits is excluded, as far as legally permissible.
13. Reviews
Customers can submit reviews after using the parking service.
BigParking reserves the right to review ratings and remove them in case of violations of legal regulations or platform guidelines.
14. Website usage
The content of the website is protected by copyright.
The platform may only be used within the framework of legal provisions.
Abusive use, in particular automated access or manipulation attempts, is prohibited.

BigParking is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
